Everyone can agree that this is probably not socially acceptable behavior, but how can they suspend/expell these students without being first proven guilty? Although the second guy's smirk is pretty suspicious looking, I don't think you should be able to be expelled just for being accused of something.

well, if what they allegedly did is actually illegal, and they are convicted as such, then expulsion is understandable, but as it stands, their semester is screwed already before any legal proceedings have even started.

i guess I've never found cotton balls to be referenced to race. Is it a hate crime to put anything white in front of a black persons house? So if I were to park a white car on their side of the street or something I could go to jail?

Sorry to point out the obvious and all dude but its a reference to slaves picking cotton and the vandalism/hate crime happened "occurred on the 48th anniversary of the Supreme Court’s decision to desegregate public transportation" (Story article).
I agree with the humor part of it and all, but this is by definition a hate crime. The only problem is how seriously hate crimes are taken. In my opinion the world is too PC today and is probably only going to get worse. I agree that the constitution protects many inalienable rights such as freedom of speech, press, assembly, etc; but as Penn (from Penn & Teller) said on their show 'Bull$hit': People do NOT have the right not to be offended.
Treat this as a misdemeanor vandalism (or just a case of littering?), but a class D misdemeanor.

You're right about that. I actually had to Google and find out the real definition of "hate crime" because I was on the edge of even agreeing with that.

QFT. Here's some kids that decided to go to college and try to get a degree that would (hopefully) give them the opportunity to do something with their lives. Now people are clamoring to get them convicted of a hate crime and all that jazz.
Did they go out and run over the first black person they saw? Or lynch him? Or raise a burning cross in his front yard? No... they threw some cotton balls on the ground.
What's next? I get arrested for offering a black man some fried chicken and he calls it a hate crime?

You know.. If those guys really committed this as a hate crime, and not just some drunk prank... then the black community is giving them just what they want by creating this giant stir... If they had just dismissed it as the ignorant and stupid antics or bigotry that it was, I would think it would go away a lot sooner...
