The supreme court did go a bit too far in the ruling, but apparently, from what i've read, local governments do this sort of stuff all the time, i.e. to even clean up Times Square in NY.

They might as well have not taken the lawsuit... now, local governments won't get any federal money if they bring up eminent domain.
