why are they worried if the music recorded cant be transfered to any other devices? They havent thrown a shitfit about Napster-to-go yet, and its basically the same thing only with a wider selection and you can listen to it in more places.

ya know, i used to feel a twinge of guilt when i got music. it's all but been erased by stupid shit like this. is loud music illegal yet? i didnt pay to hear the rap blaring out of the car next to me at the stoplight, so am i stealing it? is the guy playing it illegally sharing it?

How is it the customer's fault if XM said they were allowed to record stuff onto their Inno? Not like it's blatant enough for the consumer to think it illegal - which it sounds perfectly legal to me, if the songs aren't transferable. I thought recording songs on that player was a great idea on the part of XM, and it wasn't like they weren't considering the illegalities that could have occured from its use. They planned ahead, knowing they would get crap from RIAA unless they kept the songs solely on their device. If XM had the slightest inkling they'd be sued, they wouldn't have given the option of recording, period. Hell, I wouldn't have seen it coming.

EDIT: Wait... how is this any different from an Ipod? You pay for the songs (that comes with having the subscription to XM, right?), they are then portable, you carry them around?

But it is still radio. I don't know much about XM, but I don't think you get to choose when you listen to a particular song, think of it like wireless internet radio.

VHS/VCR and movies on TV, tapes for the radio, I don't see a difference here.

RIAA and their goons SAY that XM's player is like an ipod, and as such need to pay a royalty to them. Recall the sony walkman tape players. You could record from the radio, and then take the tapes and put them into your walkman, and, GASP!, walk around with them! They were the ipod of the 80's and 90's. I see no difference here. They just see easy money.

nope, you don't get to choose. Its just like any other radio station, and this is no different than recording something off FM radio, which, I believe is legal.

If this gets struck down, then wouldn't that by default say that copywrited music could be burned to cds or ipod or whatever you want. I mean it is just like ipod, so if it is legal then ipod w/o liscensed music should be also.... right?

I hope that everyone on the RIAA board lawyers and bigwigs all die terrible terrible deaths for not only starting the dumbest tread into protecting their income and just wasting so much of everyones goddamn time with rediculous lawsuits. Soon enough music will be illegal in fear of a copyright infringement then they will win but be out of jobs.
